ciaofashion.gr is the “Website” and “Electronic Store” for exhibiting and selling products via the Internet,
which belongs to the Greek company with the name “CIAOFASHION” based at ANOGEION 20, 18453, NIKAIA, in Greece (TIN: 145295392 / D.O.Y NIKAIAS / GEMY 154302808000) (hereinafter “ciaofashion” or the “Company” ).
These General Terms and Conditions for using the website and purchasing the products/services of our online store (hereinafter the “Terms of Use and Transactions” or the “Terms of Use”),
set out the terms and conditions of your browsing on our Website and use of it and our online store and
govern the sales contract concluded between us for the purchase of products from our online store.
Before entering our online store, we invite you to consult the Terms of Use and Transactions and make sure you agree with them.

ciaofashion.gr has received all the necessary technical and other means in order to immediately update the available quantity and sizes of our products,
however, reserves an express reservation regarding the validity of the quantities and sizes of the products available in the online store,
since they may be updated within one (3) days, from the moment of their modification.
B. MEMBER REGISTRATION
Your registration as a Member at ciaofashion.gr is desirable but not necessary in order to make a purchase from our Online Store.
By entering your requested personal information (name and surname, address, postal code of current main residence, telephone, valid email address, gender and date of birth) and accepting these Terms of Use and Transactions, you become a Member at ciaofashion.gr and we open your own Member Account.
Registration and participation as a member is free, personal, non-transferable and non-assignable.
You are responsible for the information you provide us and ciaofashion.gr relies solely on your statements regarding your personal information.

C. PURCHASING THROUGH THE STORE
1. ORDER
1.1. Completion – Order Confirmation.
You can complete your order as a guest or as a member.
During the completion of your order the system will automatically guide you through the very simple and quick registration process.
If you wish to make your purchase as a guest, your data will not be stored for any future use (except for data related to the tax authorities).
To complete the order, you must choose a payment method from the available ones and accept these terms.
The prices listed on our products include VAT. and are considered final.
Shipping and cash on delivery costs, if incurred, are added to the final payment amount and are clearly indicated on the final order form, which we send to your email address.
Upon submission of your order, it will send you a message to the email account you have registered with us, which will notify you:
That we received the order.
The products you have ordered.
Shipping and cash on delivery costs, if applicable.
The payment method.
And all the terms of the order.
1.2. Order cancellation.
Your order can be canceled:
1.2.1. Before the order is completed.
Before submitting your order, you technically have the option to “return to cart” and remove the quantities of products from your cart that you do not wish to order by pressing the “remove” button.
1.2.2. After completing the order but before receiving the products.
If the online order has been completed but not yet shipped, you can cancel it by sending an email to the email address info@ciaofashion.gr.
1.2.3. After receiving the order.
Your refusal to accept your products upon delivery by the Carrier shall constitute your right of withdrawal.
In any case, we inform you that in the event of your withdrawal, ciaofashion.gr records the event in a special file.
In the case of a second order, after a previous refusal of receipt by the same customer, ciaofashion.gr will contact the customer to confirm the new order.
In the event that the same customer refuses to receive his order a second time, then any subsequent order will be paid by bank deposit.
1.2.4. After receiving the order, due to error, due to defective products, due to loss.
After receipt your order is cancelled, in case you receive a defective product, the wrong product (not included in the final order form) or you never receive a product due to loss.
2. SHIPMENT AND DELIVERY OF PRODUCTS
2.1. Shipping charges.
The shipment of the products of your order is charged with shipping costs (if incurred) which are added to the final payment amount and are clearly indicated on the final order form.
2.2. Place – Delivery dates and times.
The days of delivery of your products are defined by the operating hours of the transport company that undertakes their transport and takes place at the place of delivery that you have stated in your order form.
If your order is completed by 12:30pm, products are delivered within three working days.
In case your order is completed by submitting it to us after 12:30pm, the delivery time increases by one working day.
The above deadlines do not apply during periods of extreme weather or strikes and in any case of force majeure, which may affect transport and delivery times.
2.3. Delivery Delay.
Our Company makes every effort for the timely and appropriate delivery of your products, however we reserve the right that the delivery of your product(s) may be delayed in the event that:
(a) The product is not in our warehouse and is delayed by our supplier.
(b) The product you ordered has already been discontinued and is unavailable due to a sudden and unannounced announcement by the supplier that the product in question has been discontinued.
(c) There is an event of force majeure such as indicative extreme weather phenomena, strikes, or any other event outside our sphere of influence and control which may affect the transportation and delivery of your order.
In the above cases we will contact you to ask if you want us to deliver the order without the product that is delayed or unavailable, or to suggest an alternative, or to inform you of the delivery time of the product that is not immediate available.
In case you are not satisfied with our proposal, you have the right to cancel the order in part or in whole and to return any money you have paid.
In case of delay, you can contact Ciao Fashion by phone, or by email at info@ciaofashion.gr, to declare your cancellation of the entire order or part of it.
3. METHODS OF PAYMENT
3.1. Cash on delivery method – Payment upon receipt of the order.
When the employee of the courier company comes to your place to deliver your products, you pay in cash the value of your order and the costs that may arise (e.g. transport costs, cash on delivery), as indicated on the form you have received, to your email address.
3.2. Payment by Debit or Credit Card.
You can pay the value of your order and the costs that may arise, as indicated on your order form (eg shipping costs), by credit card or debit card (if a payment method is available).
3.3. Payment by deposit to a Bank Account.
You can pay the value of your order and the expenses that may arise, by depositing into our company’s bank account (provided a payment method is available).
For the best service, please indicate your order code when depositing the amount.
3.4. Security.
Ciao Fashion does not manage personal information, including credit card numbers and bank account numbers, of users who choose to Pay by Debit or Credit Card, or, Pay by Bank Deposit.
These processes are protected from any unauthorized access or disclosure, loss or misuse and alteration or destruction by the credit institutions processing the transactions.
The user connection to funky-man.gr is secure, because it uses SSL (Secure Socket Layer) technology with AES 256 bit encryption.
SSL technology relies on a key code to encrypt data before it is sent over the (SSL) connection.
The security control between the data and the Server is based on the unique key code, ensuring the integrity of the communication.

4. WITHDRAWAL – CANCELLATION OF ORDER
If you wish to change a product, you have the right to do so within fourteen (14) calendar days from the date of receipt, with the same company that received the package.

The consumer has the right to withdraw without reason within fourteen (14) calendar days, if no longer period has been agreed, but returning the goods in their excellent original condition and packaging, without incurring any costs, except for the return costs.
In case of non-execution of the order as agreed, the customer has every right to cancel it.
In order to return the products they must not be worn, used, worn or washed. For hygiene reasons, used underwear and swimwear are not returnable.
Products must be in their original condition with tags and returned with proof of purchase.
Refunds will not be made without proof of purchase.
As long as all the above conditions are met, we will be happy to replace your product with any other product of similar value you wish. In case of a higher value, the difference is charged to the customer. Return costs are borne by the customer.
To return a product fill out the Sample Withdrawal Form and send it by fax or email.
5. REPLACEMENT – CHANGE OF PRODUCTS
You have the right to return the product you received, with the exception of Underwear and Swimwear, which for hygiene reasons are NOT REFUNDABLE, within 14 calendar days from the date the order was sent and to request a replacement.
The return of the products for the purpose of replacing them, does not constitute an action of withdrawal on your part and therefore the provisions of article II. C. 4. herein do not apply.
By product change, we mean replacing the product with another variant (size, color, etc.), of the same product code.
Product changes are only made if product variants are available.
We do not accept changes or returns of products, with tampered packaging, or used, or generally altered in their original condition.
We do not accept changes of underwear and swimwear, under any circumstances, for hygiene reasons.
We do not service, process, or convert products.
As long as the possibility of the first free change is given for your order, the first change is not charged with transport costs, as long as you use the transport company that we will indicate to you.
If you need to make a second change then the return costs will be borne by you.
(1) In order to return one or more products, you should contact the courier company that delivered the package to you, stating that it is a return to ciaofashion.gr, in order to receive the return package and start the process.
(2) Then place the item in its packaging with the barcode (if it has one) and its tag, the proof of order and fill in the form you will find inside the bag to indicate what change you want to make (e.g. change in number. in color or if you want a refund) and deliver the package to the courier.
(3) As soon as we receive the parcel, an availability check is carried out for the products you want to change. As long as the product/s are available, we will make the exchange and refund it to you.
In case any of the products are not available we will contact us to discuss together the replacement of your order.
In the event of a change of proven defective products, they are not exchanged for different products or a sum of money, but replaced.
It can be agreed or product replacement with another, different product, after consultation between the two parties and only if our company is willing to replace the product.
In the event that the change is made, upon agreement, with a more expensive product, you pay the difference and the new cash on delivery cost. Of course you can avoid cash on delivery by depositing the difference in the bank.
In the event of a change due to your miscalculation (color, size, etc.), the products are not exchanged for cash and the new shipping costs are borne by you.
In the event of a change of proven defective products, the shipping costs are borne by us.
In the event that the product to be changed,
a) does not prove to be defective,
b) found to have been used,
c) its packaging is damaged,
returned to the buyer with transport costs borne by him.
Every order comes with a product change form.
In case of exchange or return, the products must be in their packaging in an intact condition and must be accompanied by:
a) From the purchase document.
b) From the corresponding change form, completed.
Any change or return, not accompanied by the corresponding change or return form and proof of purchase, will not be accepted.
It is expressly agreed that:
Products are replaced if the product to be replaced is returned to our Company in the same good condition as when you originally received it.
Our Company does not replace products that are dirty, damaged, altered, damaged or are not accompanied by all the documents you received from us.

B. LIABILITY ciaofashion.gr
1. Supplier Liability and Warranty.
The manufacturer of each product you purchase is responsible for any damage caused by a defect in their product. Any agreement limiting or exempting the producer from his liability is void.

2. Liability of ciaofashion.gr for defects, loss.
funky-man.gr has towards you all the obligations provided for in the Civil Code for the seller. Especially in the case of a defect in the product we sell you, you can (a) request its repair at no cost to you, unless this is impossible or requires disproportionate costs or (b) its replacement with another (see Section II.D.6 ) or (c) withdraw following the procedure found in Section I.D.5.2.
The above obligations of our Company cease in the event that the defect has been caused by you, or the product being returned has dirt, wear, abrasions, creases and generally creates the impression that it has been used beyond what is necessary to establish its suitability , or in a narrow or broad sense of force majeure.
In any case, the products must be accompanied by the necessary legalization documents and receipts. You should exercise your above rights within fourteen (14) calendar days of receiving your products, and this period starts from the day after receipt and in any case within that period you should have returned the product to us.

We further inform you that the risk of loss or damage to the products rests with ciaofashion.gr until you or a third party designated by you as competent to receive the products on your behalf (other than the carrier) has obtained physical possession of the goods, at which time that risk is transferred to you.
However, the risk is transferred to you from the delivery of your purchased products to the carrier, if the carrier has been instructed by you to transport the goods and such an option was not offered by ciaofashion.gr, without prejudice to your rights against the carrier .
3. Limitation of Warranties-Liability.
ciaofashion.gr always acts in good faith and within the framework of what the law and these General Terms provide.
